習近平在中共中央政治局第十次集體學習時強調

加強涉外法制建設 營造有利法治條件和外部環境

中共中央政治局11月27日下午就加強涉外法制建設進行第十次集體學習。中共中央總書記習近平在主持學習時強調,加強涉外法治建設既是以中國式現代化全面推進強國建設、民族復興偉業的長遠所需,也是推進高水準對外開放、應對外部風險挑戰的當務之急。要從更好統籌國內國際兩個大局、更好統籌發展和安全的高度,深刻認識做好涉外法治工作的重要性和緊迫性,建設同高品質發展、高水準開放要求相適應的涉外法治體系和能力,為中國式現代化行穩致遠營造有利法治條件和外部環境。

武漢大學特聘教授黃惠康同志就這個問題進行講解,提出工作建議。中央政治局的同志認真聽取了講解,並進行了討論。

習近平在聽取講解和討論後發表了重要講話。他指出,法律是社會生活、國家治理的準繩。涉外法律制度是國家法制的重要組成部分,是涉外法治的基礎,發揮著固根本、穩預期、利長遠的重要作用。在強國建設、民族復興新征程上,必須堅持正確政治方向,以更加積極的歷史擔當和創造精神,加快推進我國涉外法治體系和能力建設。

習近平強調,涉外法治作為中國特色社會主義法治體系的重要組成部分,事關全面依法治國,事關我國對外開放和外交工作大局。推進涉外法治工作,根本目的是用法治方式更好維護國家和人民利益,促進國際法治進步,推動構建人類命運共同體。必須堅定不移走中國特色社會主義法治道路。

習近平指出,涉外法治工作是一項涉及面廣、聯動性強的系統工程,必須統籌國內和國際,統籌發展和安全,堅持前瞻性思考、全局性謀劃、戰略性佈局、整體性推進,加強頂層設計,一體推進涉外立法、執法、司法、守法和法律服務,形成涉外法治工作大協同格局。要堅持立法先行、立改廢釋並舉,形成系統完備的涉外法律法規體系。要建設協同高效的涉外法治實施體系,提升涉外執法司法效能,推進涉外司法審判體制機制改革,提高涉外司法公信力。要積極發展涉外法律服務,培育一批國際一流的仲裁機構、律師事務所。要深化執法司法國際合作,加強領事保護與協助,建強保護我國海外利益的法治安全鏈。要強化合規意識,引導我國公民、企業在“走出去”過程中自覺遵守當地法律法規和風俗習慣,運用法治和規則維護自身合法權益。

習近平強調,要堅定維護以國際法為基礎的國際秩序,主動參與國際規則制定,推進國際關係法治化。積極參與全球治理體系改革和建設,推動全球治理朝著更加公正合理的方向發展,以國際良法促進全球善治,助力構建人類命運共同體。

習近平指出,法治同開放相伴而行,對外開放向前推進一步,涉外法治建設就要跟進一步。要堅持在法治基礎上推進高水準對外開放,在擴大開放中推進涉外法治建設,不斷夯實高水準開放的法治根基。法治是最好的營商環境,要完善公開透明的涉外法律體系,加強智慧財産權保護,維護外資企業合法權益,用好國內國際兩類規則,營造市場化、法治化、國際化一流營商環境。要主動對接、積極吸納高標準國際經貿規則,穩步擴大制度型開放,提升貿易和投資自由化便利化水準,建設更高水準開放型經濟新體制。要對標國際先進水準,把自由貿易試驗區等高水準對外開放的有效舉措和成熟經驗及時上升為法律,打造開放層次更高、營商環境更優、輻射作用更強的對外開放新高地。要全面提升依法維護開放安全能力。完善外國人在華生活便利服務措施和相關法律法規。

習近平強調,要加強專業人才培養和隊伍建設。堅持立德樹人、德法兼修,加強學科建設,辦好法學教育,完善以實踐為導向的培養機制,早日培養出一批政治立場堅定、專業素質過硬、通曉國際規則、精通涉外法律實務的涉外法治人才。健全人才引進、選拔、使用、管理機制,做好高端涉外法治人才培養儲備。加強涉外幹部隊伍法治能力建設,打造高素質專業化涉外法治工作隊伍。各級領導幹部要帶頭尊法、學法、守法、用法,切實提升涉外法治思維和依法辦事能力。

習近平指出,要堅定法治自信,積極闡釋中國特色涉外法治理念、主張和成功實踐,講好新時代中國法治故事。加強涉外法治理論和實踐前沿課題研究,構建中國特色、融通中外的涉外法治理論體系和話語體系,彰顯我國法治大國、文明大國形象。中華法係源遠流長,中華優秀傳統法律文化蘊含豐富法治思想和深邃政治智慧,是中華文化的瑰寶。要積極推動中華優秀傳統法律文化創造性轉化、創新性發展,賦予中華法治文明新的時代內涵,激發起蓬勃生機。


Xi stresses foreign-related legal system development

Xi Jinping, general secretary of the Communist Party of China (CPC) Central Committee, has stressed the need to strengthen foreign-related legal system development, as he chaired a group study session of the Political Bureau of the CPC Central Committee on Monday.

Xi highlighted the need to create law-based governance conditions and a favorable external environment for advancing Chinese modernization.

Xi emphasized that bolstering the rule of law in foreign affairs serves the long-term need for building a strong nation and advancing national rejuvenation through a Chinese path to modernization.

He further underscored the immediate importance of foreign-related legal system development in fostering high-standard opening-up and addressing external risks and challenges.

Calling for attention to the importance and urgency of the issue, Xi stressed the need to foster a foreign-related legal system and capacity that meet the needs of high-quality development and high-standard opening-up.

A professor from Wuhan University gave a lecture, after which members of the Political Bureau had a discussion.

Speaking after the discussion, Xi pointed out that foreign-related legal framework is an important part of China's legal system.

He emphasized that the fundamental purpose of advancing law-based governance in foreign-related affairs is to safeguard the interests of the country and the people through legal means, facilitate progress in international rule of law, and advance the building of a community with a shared future for humanity.

The path of socialist rule of law with Chinese characteristics must be followed with unswerving commitment, Xi added.

Xi underscored the importance of well-structured top-level design, adding that foreign-related legislation, law enforcement, jurisdiction, law compliance and legal services ought to be advanced simultaneously.

In addition, efforts should be taken to advance reform in the system and mechanism of foreign-related trial and judicature, said Xi.

He also highlighted the need to cultivate arbitration institutions and law firms of international prestige.

Xi urged efforts to build a strong legal security chain to protect China's overseas interests.

He noted the necessity for guiding Chinese citizens and enterprises to abide by local laws and regulations when going abroad, and that they should apply laws and rules to safeguard their legitimate rights and interests.

The international order based on international law must be resolutely upheld, Xi noted, adding that China should actively take part in the formulation of international rules and promote the rule of law in international relations.

Xi said the rule of law is the best environment for doing business.

He stressed building an open and transparent foreign-related legal system, strengthening the protection of intellectual property rights, safeguarding the legitimate rights and interests of foreign-funded enterprises, and fostering a market-oriented, law-based and internationalized business environment.

Noting that the institutional opening-up should be steadily expanded and trade and investment liberalization and facilitation should be improved, Xi said effective measures and mature experience of high-standard opening-up such as the ones tested in pilot free trade zones should be timely elevated to law provisions.

Efforts should be made to improve measures and relevant laws and regulations to facilitate foreigners who live in China, Xi added.

Xi also underlined the importance of fostering professional personnel.

Xi emphasized the need to strengthen confidence in the rule of law, and actively interpret China's unique concepts, propositions, and successful practices related to the rule of law in foreign affairs. He highlighted efforts to promote the creative transformation and development of fine traditional Chinese legal culture.
